Throughout these Terms of Service, "we", "us" and "our" refer to IBC Container Supplies (a trading name of Express Matting Services Ltd), and "you" refers to the customer. By visiting our website or placing an order, you agree to these Terms and our Privacy Policy. These Terms do not affect your statutory rights as a consumer.

2. Products, Pricing and Availability

We take care to describe every product accurately — including capacity, condition grade (new, rebottled, or reconditioned), pallet type, valve size, UN approval status, and food suitability. Reconditioned units may show cosmetic wear, which is stated on the product page. Colours and appearance may vary slightly from photographs.

All prices are shown in pounds sterling (GBP) and include UK VAT at 20%. Delivery charges are shown separately at checkout before you confirm your order. If we discover a genuine pricing or description error affecting an order you have placed, we will contact you before dispatch and give you the option to reconfirm at the correct price or cancel for a full refund. Products are offered subject to availability.

3. Orders and Contract Formation

Your order is an offer to buy. We will send you an order confirmation email; the contract between us is formed when we dispatch your order. We may decline or cancel an order where we reasonably suspect fraud, where a product was listed in error, or where we cannot verify billing information — any payment taken will be refunded in full. If we do not accept, change, or cancel an order, we will notify you using the contact details provided at the time of ordering.

4. Payment

Payment is taken in full at checkout. We accept major credit and debit cards through Shopify's secure, PCI-DSS-compliant checkout; we do not store your card details. You must be 18 or over to place an order. You agree to provide current, complete and accurate purchase and payment information.

5. Shipping and Delivery

We deliver within the United Kingdom only. Orders placed before 2:00 PM (GMT) on a working day begin processing the same day; dispatch takes 1–2 business days and transit a further 3–5 business days (4–7 business days total). A flat delivery charge of £65 applies per order. Delivery timeframes are estimates; where a significant delay occurs, we will contact you, and you may cancel affected orders for a full refund. Full details are in our Shipping Policy. Risk in the goods passes to you on delivery; title passes on the later of delivery or receipt of payment in full.

6. Cancellations, Returns and Refunds

You may cancel your order free of charge at any time before dispatch. If you are a consumer, you also have a 14-day right to cancel after delivery under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, with a further 14 days to return the goods. Faulty, damaged or misdescribed goods will be replaced or refunded in full, including delivery costs, in accordance with the Consumer Rights Act 2015. Full details are in our Refund Policy.

7. Your Statutory Rights

Nothing in these Terms affects your statutory rights under UK law, including under the Consumer Rights Act 2015 (goods must be of satisfactory quality, fit for purpose, and as described) and the Consumer Contracts Regulations 2013.

8. Product Use and Safety

IBC containers must be used in accordance with their stated specifications. Units marked "not suitable for food products" must not be used for food or drink. Only UN-approved units may be used for hazardous materials, and it is your responsibility to ensure the container you select is appropriate and compliant for your intended contents and any applicable transport regulations. If in doubt, contact us before ordering — we are happy to advise.

9. Relationship with Shopify

IBC Container Supplies (a trading name of Express Matting Services Ltd) is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with IBC Container Supplies (a trading name of Express Matting Services Ltd). By using this website, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and us, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with us. Certain personal information may be subject to Shopify's Privacy Policy, available at shopify.com/legal/privacy/app-users.

Occasionally information on this website may contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any errors and to update information or cancel affected orders (with a full refund of any payment taken) if any information is inaccurate, without prior notice.

14. Limitation of Liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law. Subject to that, we are not liable for losses that were not foreseeable to both parties when the contract was formed, losses not caused by our breach, or business losses (including loss of profits, revenue, data, or business interruption) where products are purchased for consumer use. Our total liability in connection with any order shall not exceed the price paid for that order, except where the law provides otherwise.

15. Indemnification

If you use the website or products in breach of these Terms or applicable law, you agree to indemnify us against losses, damages, and claims (including reasonable legal fees) arising from that breach, to the extent permitted by law. Nothing in this section limits your statutory rights as a consumer.

16. Events Outside Our Control

We are not responsible for delays or failure to perform caused by events outside our reasonable control (for example severe weather, industrial action, or carrier disruption). We will keep you informed and take reasonable steps to minimise the effect of the delay; if the delay is substantial, you may cancel affected orders for a full refund.

17. Severability, Waiver and Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right or provision shall not constitute a waiver. These Terms, together with the policies referenced in them, constitute the entire agreement between you and us regarding your use of this website and supersede prior agreements.

18. Changes to These Terms

We may update these Terms from time to time by posting the revised version on this page. The version published at the time you place your order applies to that order. Your continued use of the website following changes constitutes acceptance of those changes.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Disputes are subject to the jurisdiction of the courts of England and Wales; if you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
